Did you know that Michigan has a roller blading statute? It puts all skaters on notice of the inherent dangers associated with skating:

445.1725. Roller skating participants; acceptance of inherent obvious and necessary dangers

Sec. 5. Each person who participates in roller skating accepts the danger that inheres in that activity insofar as the dangers are obvious and necessary. Those dangers include, but are not limited to, injuries that result from collisions with other roller skaters or other spectators, injuries that result from falls, and injuries which involve objects or artificial structures properly within the intended travel of the roller skater which are not otherwise attributable to the operator’s breach of his or her common law duties.

This is an assumption of the risk statute. What does it mean to assume the risk? Assumption of risk is a defense to a claim. You’re basically saying that while you may have injured the person bringing the cause of action, you’re not responsible because the injury arose out of inherent dangers of skating – like an accidental collision.

This statute doesn’t bar all claims – it merely puts people on notice that skating is an inherently dangerous activity.

The purpose of the Roller Skating Act was to cut down on liability of owners and operators for injuries resulting from inherent dangers of the sports, as opposed to from negligence of area operators.
