Michigan Pothole Woes: Fix MI Potholes
I feel like all you hear about lately are potholes: potholes here, potholes there, potholes are everywhere.
Jon Hoadley, a candidate running for the 60th district of the Michigan State House of Representatives, started a website to document Michigan’s terrible pot hole problem: FixMiPotholes.com.
While this blog is not intended to serve as an endorsement for Goodwin & Scieszka, we do like the idea of the website. It certainly puts the road commission and government on notice about these treacherous potholes.
Check out these facts about Michigan roads, according to the site:
- Michigan has the lowest per capita investment in infrastructure in the country. This means we’re spending the least amount per person on our roads in the entire country, and it shows.
- The average Michigan resident pays $357 annually in unnecessary repairs to their vehicles due to road conditions.
Michiganders shouldn’t have to swerve to avoid costly damages to their cars. Swerving puts yourself and other drivers in danger and can lead to costly car accidents.
The government is only liable for unreasonable and dangerous defects in the highway if they knew or should have known about the defect. Guess what? That statute is narrowly interpreted, meaning the government is not responsible when it fails to remove a natural accumulation of ice and snow. The government can argue that since potholes are caused by a natural accumulation snow and ice, it is not responsible.
If the government is immune to liability, there’s only one thing we can do to make sure Michiganders are safe while driving – fix the Michigan pothole problem.
Over the next couple weeks, our firm will seek to highlight various initiatives regarding potholes.
